Overview
Separation of powers and the system of checks and balances are integral to the functioning of India's constitutional democracy and its public institutions. Passing constitutional muster is non-negotiable for every legislative and executive action and serves as a vital safeguard against arbitrary exercise of State power and infringement of fundamental rights. The Constitution not only defines the limits of governmental authority but also provides the framework within which public power must be exercised in accordance with the rule of law.
Our Constitutional Law practice centres on questions involving the interpretation and enforcement of constitutional rights, judicial review of legislative and executive action, and the limits of governmental power. We have been involved in constitutional matters concerning challenges to legislation, delegated legislation, executive decisions, and administrative actions where the exercise of State power has been alleged to be colourable, manifestly arbitrary, unreasonable, or otherwise violative of constitutional guarantees. Our experience also extends to matters involving the interpretation of constitutional provisions, separation of powers, and the exercise of writ jurisdiction by constitutional courts.
